style=\"padding-left: 40px;\">The tax rate ITP for real estate professionals is, in short,<strong> a reduction of the ITP, which is reduced from 7%<\/strong> (which is the general rate for purchases of second homes) <strong>to 2% for real estate professionals<\/strong>, provided that the property is destined for resale and certain conditions are met.<\/p>\n<h4><span style=\"color: #ff7231;\"><u>What requirements are necessary to obtain the tax reduction?<br \/>\n<\/u><\/span><\/h4>\n<p style=\"padding-left: 40px;\">According to the <strong>law 5\/2021 of the Andalusian Autonomous Community of Andalusia<\/strong>, and by the provisions of <strong>Article 44<\/strong> of the same,<br \/>\na) The purchaser of the property (whether an individual or a legal entity) incorporates this property into its current <strong>assets.<\/strong> This acquisition must be formalised in a notarial, administrative or judicial public document.<br \/>\nb) <strong>That the property is sold within five years of its purchase<\/strong>, and said sale is made using a public deed before a notary, and provided that this transfer is subject to Transfer Tax and is not an part of the tax liability resulting from <strong>the difference between the application of the general tax rate and the reduced rate.<\/strong> This means that, although the tax is settled for<strong> the amount of 2% instead of 7%<\/strong>, the resulting difference between these two is provisionally settled by the administration at the expense of the property being resold within a <strong>maximum period of 5 years.<\/strong><\/p>\n<p style=\"padding-left: 40px;\"><strong>Example<\/strong>: Purchase price: 200.000 euros.<br \/>\n<strong>ITP 2%<\/strong>: 4.000 euros<br \/>\n<strong>Captive liquidation:<\/strong> 10.000 euros<\/p>\n<h4><span style=\"color: #ff7231;\"><u>What happens if I do not sell the property within 5 years?<br \/>\n<\/u><\/span><\/h4>\n<p style=\"padding-left: 40px;\">If the property is not resold within this period, you will have to pay <strong>the difference of the cautionary liquidation.<\/strong><\/p>\n<h4><span style=\"color: #ff7231;\"><u>What do I states in the document formalising the acquisition his intention <strong>to incorporate the property into his current assets.<\/strong> This declaration must be expressly stated in the public notarial
