Die Regelung derselben findet sich in der \u201eLey de Ordenaci\u00f3n de la Edificaci\u00f3n\u201c, auf Deutsch das Bauleitungsgesetz, insbesondere in den Artikeln 17 und 18.<\/p>\n<p>Die folgenden Fristen m\u00fcssen ab der Abnahme des Baus ohne Vorbehalte oder ab der Behebung der Vorbehalte gez\u00e4hlt werden:<\/p>\n<p><strong><span style=\"color: #ff7231;\">1)<\/span> <span style=\"color: #ff7231;\">Zehn Jahre f\u00fcr Sachsch\u00e4den<\/span><span style=\"color: #ff7231;\">,<\/span><\/strong> die am Geb\u00e4ude durch M\u00e4ngel oder Fehler an den Fundamenten, St\u00fctzen, Tr\u00e4gern, Balken, B\u00f6den, tragende W\u00e4nde oder anderen Strukturelementen verursacht wurden und die die mechanische Festigkeit und Stabilit\u00e4t des Geb\u00e4udes direkt beeintr\u00e4chtigen.<\/p>\n<p><strong><span style=\"color: #ff7231;\">2)<\/span> <span style=\"color: #ff7231;\">Drei Jahre f\u00fcr Sachsch\u00e4den,<\/span><\/strong> die am Geb\u00e4ude durch M\u00e4ngel oder Fehler an den Bauelementen oder Installationen verursacht wurden, und dadurch nicht die Anforderungen der gesetzlichen Bewohnbarkeit beinhalten.<\/p>\n<p><span style=\"color: #ff7231;\"><strong>3)<\/strong> <\/span><strong><span style=\"color: #ff7231;\">Ein Jahr f\u00fcr Sachsch\u00e4den<\/span><\/strong> aufgrund von M\u00e4ngeln oder Fehlern bei der Ausf\u00fchrung, die die \u00e4u\u00dferlichen Elemente betreffen.<\/p>\n<p>Die zivilrechtliche Verantwortung ist pers\u00f6nlich und individuell. Wenn jedoch die Schadensursache nicht individualisiert werden kann oder nachgewiesen wird, dass mehrere daran beteiligt sind, kann die Verantwortung gesamtschuldnerisch eingefordert werden.
